On January 6th, 2010, at about 0304 hours, the Douglas County Communications Center received a report from an alarm company of an alarm activation at the Rose Garden Inn in Drain. The Douglas County Sheriff’s Office responded to the alarm, and while en route, were advised of a citizen’s report of a burglary in progress at the Why Not Tavern in Yoncalla. The citizen was able to provide suspect vehicle information. The Deputies then responded to the call of the burglary in progress at the Why Not Tavern. When the Deputies arrived, they found that the suspects had left.

An area search was conducted by the Deputies. The suspect’s vehicle was located in an alleyway about two blocks away from the Why Not Tavern. Deputies were able to follow foot impressions to a residence in the 400 Block of Alder Street, Yoncalla, where they observed items taken in the burglary at the Why Not Tavern break in. Deputies made contact with the occupants of the residence, and found more evidence of the burglary inside of the residence, as well as a handgun.

The Deputies were able to determine that Nicholas Payne, and Hiram Hartness were also responsible for the earlier attempted burglary at the Rose Garden Inn.

Both Nicholas Payne and Hiram Hartness were lodged at the Douglas County Jail on charges of Burglary II, Attempted Burglary II, Criminal Mischief I, Theft III and Felon in Possession of Firearm.
