Subject: Fatal Shooting Investigation

On Friday, September 25, 2009, Douglas County Communications received a report of a shooting that had occurred in the 100 Block of Battle Mountain Road, Azalea, Oregon.
Deputies from the Douglas County Sheriff’s Office Riddle Patrol Sub-Station, and Glendale Ambulance responded to the scene, as did Detectives from the Douglas County Major Crimes Team.
Upon arrival, the first responders found that 93 year old Clarence Hartley was deceased, from an apparent gunshot wound. Clarence Hartley’s remains were later removed from the scene by the Douglas County Medical Examiner’s Office.
An investigation was conducted by the Major Crimes Team, which included members from the Douglas County Sheriff’s Office, Roseburg Police Department, Oregon State Police, Douglas County District Attorney’s Office and the Douglas County Medical Examiner’s Office.
The Detectives learned that the property where the incident occurred is owned by the Dewart family, and Clarence Hartley was a relative of the Dewart’s, who was living on the property. There was a confrontation between Clarence Hartley and Clement Dewart. During the confrontation, Clement Dewart shot Clarence Hartley, after Clarence Hartley pointed a gun at Clement Dewart.
Clement Dewart cooperated with the Detectives during the investigation. He was not arrested.
The investigation is continuing, and at its conclusion will be forwarded to a Douglas County Grand Jury for a review of any possible criminal charges.
